I think, in this situation, it depends a bit on *exactly* what the  
people on the phone say. If they tell you 'you can reach the licensee  
in this other fashion', then isn't it simply that you *have* reached  
the owner and they've communicated to you how to reach the licensee,  
a completely different entity?

On the other hand, if it simply says, "this number doesn't accept  
calls, you need to e-mail XXX at YYY" then that's clearly a violation of  
criterion 3.

Does that logic make sense?
