[RFCI-Discuss] Misconfigured secondary MX and listing in abuse & postmaster

Is misconfigured secondary MX a valid reason for listing in 
abuse & postmaster?

Example:
* energis.pl lists two MXes
* secondary MX replies 
    550 5.7.1 <abuse at empolis.pl>... Relaying denied
    550 5.7.1 <postmaster at empolis.pl>... Relaying denied

P.S.
To make things worse in energis.pl case access to primary MX is blocked
from my IP
    telnet: Unable to connect to remote host: Connection refused
